Terms & Conditions

1. Agreement to Terms

These Terms & Conditions ("Terms") govern your access to and use of the Drone Your Own website and platform (the "Service"), operated by Drone Your Own ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Drone Your Own is a marketplace that connects clients seeking aerial drone work ("Clients") with independent drone pilots ("Pilots"). We are not a party to the agreements between Clients and Pilots except as described in these Terms with respect to payments.

2. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate information and to keep your account credentials secure. You are responsible for activity that occurs under your account.

3. Pilot Obligations

Pilots represent that they hold a current FAA Part 107 Remote Pilot Certificate and will comply with all applicable laws and regulations when performing work, including FAA rules and local airspace and privacy requirements.

Pilots agree to maintain the insurance coverage they represent on the Service, to perform work professionally and as described in their accepted offer, and to deliver agreed files through the platform.

4. Client Obligations

Clients agree to describe jobs accurately, to provide necessary site access and information, and to review and approve delivered work in good faith. Clients are responsible for ensuring they have the right to authorize drone operations at the specified locations.

5. Payments, Fees, and Escrow

When a Client accepts a Pilot's offer, the Client pays the Pilot's quoted price plus applicable platform and service fees through our payment processor. The Pilot's quoted amount is held (in escrow) and is not released to the Pilot until the Client approves the completed work.

Pilots receive 100% of their quoted price; platform and service fees are charged in addition to that price and are disclosed at checkout. Payouts to Pilots are made to their connected payment account and are subject to the processor's payout schedule.

Fees may change; the fees in effect at the time of a transaction apply to that transaction.

6. Cancellations, Refunds, and Disputes

Because funds are held until the Client approves delivery, a Client may be eligible for a refund of held funds if a job is not completed as agreed, subject to our review. If a Client and Pilot dispute a job, we may, at our discretion, review the matter and determine the release or refund of held funds.

This section describes our general approach; specific refund and dispute procedures will be provided in the Service.

7. Content and Intellectual Property

Pilots retain ownership of the work they create unless they agree otherwise with a Client. Upon full payment for a job, and unless the parties agree otherwise, the Client receives the rights to the delivered work as described in the job or offer.

You grant Drone Your Own a limited license to host, store, and display content you upload as necessary to operate the Service.

8. Prohibited Conduct

You agree not to: use the Service for unlawful purposes; circumvent the platform to avoid fees; misrepresent your identity, certifications, or insurance; upload unlawful or infringing content; harass other users; or attempt to disrupt or compromise the Service.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not guarantee the quality, safety, legality, or outcome of any job, and we do not employ Pilots or Clients.

10. Limitation of Liability

To the fullest extent permitted by law, Drone Your Own will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of your use of the Service. Our total liability for any claim relating to the Service will not exceed the fees we received in connection with the transaction giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Drone Your Own from claims, damages, and expenses arising from your use of the Service, your content, or your violation of these Terms or applicable law.

12. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or to protect the Service and its users. You may stop using the Service and request account deletion at any time.

13. Governing Law

These Terms are governed by the laws of the State of Maine, without regard to its conflict-of-laws principles, unless otherwise required by applicable law.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page and update the effective date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
